The head of the Electoral System Reform Commission, Badiul Alam Majumdar, has expressed his satisfaction with the High Court's historic ruling that strikes down two provisions in the 15th Amendment, which had annulled the caretaker government system. According to Majumdar, this verdict has reopened a crucial pathway for the country’s return to a democratic system.  

Earlier today, the High Court declared Articles 20 and 21 of the 15th Amendment—concerning the annulment of the caretaker government system—void and unconstitutional, stating that these articles had undermined the fundamental structure of the constitution. Additionally, Articles 7(A) and 7(B), introduced through the same amendment, were also invalidated by the court.  

The 15th Amendment, passed under the Awami League government on June 30, 2011, and gazetted on July 3, 2011, had faced widespread criticism. On August 18, five prominent citizens, including SHUJAN Secretary Badiul Alam Majumdar, filed a writ challenging the amendment. They argued that the amendment conflicted with the constitution. Several political entities, including BNP, Gono Forum, and Bangladesh Jamaat-e-Islami, joined the petition as interveners.  

In his reaction to the ruling, Majumdar described the judgment as “historic” and a “seminal decision.” He expressed his joy, not just for himself but for the people of the country, stating that the verdict had opened a significant door for the restoration of democracy. However, he noted that this opportunity depended on collective behavior going forward. "Returning to democracy requires change—if politicians and citizens alike take responsibility and alter their behavior, democracy can be restored. If not, it will remain elusive," he cautioned.  

Majumdar also highlighted how an authoritarian system had been entrenched through two mechanisms: the abolition of the 13th Amendment (the caretaker government system) allowing elections under partisan governments, and the inclusion of Article 7(A) in the constitution.  

Reflecting on the struggle that led to this ruling, Majumdar expressed gratitude to the court for recognizing the efforts of himself and others who had been vigilant and active in opposing these constitutional changes. He thanked the judiciary and emphasized that their fight was on behalf of the people, truth, and justice, aimed at restoring the democratic framework.  

“This ruling is a victory for the people of the entire country,” Majumdar concluded, expressing hope for the future of Bangladesh’s democracy.
